Warning: A solicitor does not have to be better technically than other average solicitors. A solicitor can make a lot of mistakes apparently before a charge of negligence is justified, it almost has to be gross and deliberate.
Three criteria are needed to justify a negligence claim:
1.Duty of care or contract
2.Breach of above.
3. Provable loss, usually financial
N.B. Only the Courts or the Solicitors' Indemnity Fund can deal with a negligence claim. You will deal first with the Insurance Company covering the solicitor and, if not agreed, then go to Court. It is expensive, time consuming and may need the employment of another solicitor.
